GERALD D.WELLS III

Mr. Wells is a partner in the Philadelphia office of Lynch Carpenter. He has dedicated his entire career prosecuting class actions on behalf of aggrieved individuals, including employees and consumers, focusing particularly on the areas of ERISA, wage and hour, and ADA litigation. Mr. Wells has been recognized as a leader in class action litigation and has spoken at numerous conferences on topics ranging from fiduciary liability and developments in ERISA jurisprudence to recent developments in the field of wage and hour law. He has been counsel of record in several notable decisions including the Supreme Court’s decision in the action styled Genesis Healthcare Corp. v. Symcyzk, 133 S. Ct. 1523 (2013). Additionally, Mr. Wells successfully argued before the Eleventh Circuit in Rafferty v. Denny’s, Inc., 13 F.4th 1166 (11th Cir. 2021), a decision which the Department of Labor cited extensively when issuing its final rule regarding 29 C.F.R. § 531.56. He also served as trial counsel in Verma v. 3001 Castor, Inc., successfully obtaining a jury verdict in the Eastern District of Pennsylvania of more than $4.5 million for a class of dancers at a Philadelphia area gentleman’s club. That verdict was subsequently sustained by the Third Circuit, 937 F. 3d 221 (3d Cir. 2019).
Some of the notable settlements Mr. Wells has helped obtain include: Gedek v. Perez, et al., (In Re Kodak ERISA Litig.), No. 6:12-cv-06051 (W.D.N.Y.) (served as co-lead counsel in ERISA action that resulted in a $9.7 million class settlement); Koenig v. Primanti Corp. et al., No. 2:16-cv-01402 (W.D. Pa.) ($2.1 million settlement on behalf of class and collective action members); and Graudins v. Kop Kilt, LLC, No. 14-2589, (E.D. Pa.) ($300,000 settlement for class of employees at single restaurant who alleged, among other things, tip credit notification violation). In his career, Mr. Wells has helped recover over $100 million dollars for aggrieved employees.
Mr. Wells was born and raised in North Philadelphia and is an avid Philadelphia sports fan. In addition to his legal practice, Mr. Wells enjoys international travel. To date, he has snorkeled with sharks, bungee jumped in the Swiss Alps, ran with the bulls in Pamplona, and is an annual attendee of Munich’s Oktoberfest.
